But now, Big Pharma is abusing the system with serial patent litigation—suing generic makers again and again with weaker, later-issued patents. These lawsuits can drag on for years, blocking affordable medicines and forcing patients, families, employers, and taxpayers to keep paying monopoly prices.
Add a “use it or lose it” rule so companies can’t withhold patents during the first lawsuit and spring them later.
Limit damages from weak, late-filed patents so they can’t be used to intimidate generic makers after brands already lost on their core patents.
